Terms and Conditions

Welcome to Skate+ (also referred to as SkatePlus, Sk8+, or Sk8Plus), an application developed and operated by Hijinx Media Corporation (“Hijinx,” “we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your access to and use of the Skate+ app, including all features, services, and content provided therein (collectively, the “App”). By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Overview of SkatePlus

SkatePlus is a platform that enables users to:

  • Play the game SKATE via P2P video chat with others
  • Share the App and video recordings with friends or the public
  • Connect with friends, make new ones, and play together
  • Skate solo and broadcast gameplay or solo skate

The SkatePlus app is designed for entertainment and social interaction among the skateboarding community.

2. Eligibility

  • General Use: You must be at least 13 years of age to use the App without parental consent.
  • Users Under 13: The App is not specifically designed for or targeted to users under If you are under 13, you may only use the App with the express consent and supervision of a parent or legal guardian. By using the App, you represent that you meet these eligibility requirements or have obtained proper consent.
  • Parental Responsibility: Parents or guardians of users under 13 are responsible for monitoring their child’s use of the App and ensuring compliance with these Terms.

3. User Accounts

  • To access certain features (e.g., connecting with friends, sharing content, or broadcasting), you may need to create an account.
  • You agree to provide accurate and complete information during registration and to keep your account credentials secure.
  • You are solely responsible for all activity under your account.

4. User Content

  • Ownership: You retain ownership of video recordings and other content you create, stream, or upload to the App (“User Content”), such as gameplay videos or solo skate sessions.
  • License to Hijinx: By uploading or streaming User Content, you grant Hijinx Media Corporation a worldwide, non-exclusive, royalty-free, perpetual, and transferable license to use, reproduce, distribute, display, and modify your User Content for operating, promoting, and improving the App, including in advertisements or within the App itself.
  • Responsibility: You are solely responsible for your User Content and any consequences of sharing Hijinx does not endorse or guarantee the accuracy, quality, or appropriateness of User Content.
  • Objectionable Content: Streaming objectionable content is grounds for immediate termination from the SkatePlus app. Apps should not include content that is offensive, insensitive, upsetting, intended to disgust, in exceptionally poor taste, or just plain creepy. Examples of prohibited content include:
    • Defamatory or Discriminatory Material
      Content that is defamatory, discriminatory, or mean-spirited—especially references to religion, race, sexual orientation, gender, national or ethnic origin, or other targeted groups—is not allowed, particularly if it could humiliate, intimidate, or cause harm to an individual or group.
    • Graphic Violence or Encouragement of Harm
      Realistic depictions of people or animals being killed, maimed, tortured, or abused are not permitted, nor is any content that promotes violence. In games, “enemies” cannot be based solely on real races, cultures, governments, corporations, or other identifiable entities.
    • Dangerous Behavior or Weapons Use
      Content that promotes illegal or reckless use of weapons or dangerous objects is not allowed. Apps must not enable the purchase of firearms or ammunition.
    • Sexually Explicit or Pornographic Material
      Overtly sexual or pornographic content—defined as explicit descriptions or depictions of sexual organs or acts intended to arouse rather than inform or entertain emotionally or artistically—is prohibited. This includes “hookup” apps and any app that may include or promote pornography, prostitution, human trafficking, or exploitation.
    • Inflammatory Religious Content
      Inflammatory commentary or misleading/inaccurate representations of religious texts or beliefs are not allowed.
    • Exploitation of Sensitive Events
      Content that seeks to capitalize on or profit from current or recent tragedies—like violent conflicts, terrorist attacks, or epidemics—is strictly prohibited.
    • Excessive Profanity
      The use of strong language should be limited and appropriate to the app’s context and audience. Apps that contain or promote excessive, gratuitous, or offensive profanity may be rejected or require additional content warnings or restrictions.
    • Bullying or Harassment
      Content that enables, encourages, or facilitates bullying, harassment, or targeted abuse of any kind—whether toward individuals or groups—is strictly prohibited. This includes cyberbullying, doxxing, coordinated attacks, or any behavior that may lead to physical, emotional, or psychological harm.

5. Data Collection and Use

  • User Metrics: Hijinx Media Corporation owns and retains all rights to general, non-identifying user metric data (e.g., usage statistics, activity patterns, and geotargeting data) collected through your use of the App.
  • Advertisers: We may share aggregated, non-identifying data with advertisers for targeting and marketing purposes. This data will not include personally identifiable information unless you explicitly consent otherwise.
  • Account Deletion: Deleting your account will remove user-generated videos and images; however, gameplay data will be retained and anonymized in a way that ensures you are not identifiable. This process will also disable your account and release your username, requiring a new account to be created for future use.
  • Data Retention: Hijinx reserves the right to retain user metric data indefinitely for analytics, improvement of the App, and other business purposes. User Content (e.g., videos) remains your property, subject to the license granted in Section 4.
  • No Targeting of Users Under 13: The App does not target users under 13 for data sales or marketing purposes.

6. Sharing and Broadcasting

  • You may share the App with others and broadcast your gameplay or solo skate sessions within the App, subject to these Terms and applicable
  • Hijinx is not responsible for how others use or distribute content you share outside the App.

7. Release of Liability

  • Assumption of Risk: You use the App at your own risk. Hijinx Media Corporation is not liable for any physical injuries, property damage, or other harm that may occur while using the App, including during skateboarding activities or video chats.
  • Third-Party Interactions: Hijinx is not responsible for the actions, conduct, or content of other users or third parties you interact with through the App.
  • Service Interruptions: Hijinx is not liable for any loss or damage caused by interruptions, technical failures, or unavailability of the App.

8. No Monitoring or Censorship Obligation

  • Hijinx Media Corporation does not actively monitor, censor, or moderate any User Content or interactions on the App, including live or recorded streams. By using the App, you acknowledge and agree that Hijinx is not responsible for any User Content, including content that may be offensive, inappropriate, or otherwise objectionable.
  • You further agree to release Hijinx Media Corporation from any liability, claims, or obligations arising from user-generated content or interactions on the App.

  • However, Hijinx reserves the right (but has no obligation) to review, remove, restrict access to, or take other action against any content or user that we, in our sole discretion, determine to be in violation of these Terms or applicable laws. Users are encouraged to report any content or behavior they believe violates these Terms or the App’s Code of Conduct. Reports may be flagged and submitted through the in-app “one-tap reporting” tool. Upon receiving a report, Hijinx may review the reported content and take any action deemed appropriate at our sole discretion.

  • Examples of objectionable content or behavior that may result in account action include, but are not limited to:
    • Content that violates any applicable law or regulation;
    • Harassment, bullying, hate speech, or discriminatory remarks;
    • Sexual, violent, or graphic content that is inappropriate for the platform;
    • Spam, scams, or deceptive practices;
    • Intentional behavior meant to harm, harass, or offend another user.

9. Indemnification

You agree to indemnify, defend, and hold harmless Hijinx Media Corporation, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising out of:

  • Your use of the App;
  • Your User Content;
  • Your violation of these Terms; or
  • Your violation of any third-party rights or applicable

10. Intellectual Property

  • The App, including its design, code, and branding (e.g., Skate+, SkatePlus, Sk8+, Sk8Plus), is owned by Hijinx Media Corporation and protected by copyright, trademark, and other intellectual property
  • You may not reproduce, modify, or distribute the App or its components without our prior written consent, except as expressly permitted by these

11. Termination

  • We may suspend or terminate your access to the App at any time, with or without notice, for any reason, including if we believe you have violated these Terms.
  • Upon termination, your right to use the App ceases, but these Terms (e.g., ownership, liability, and indemnification provisions) will continue to apply as relevant.

12. Disclaimer of Warranties

The App is provided “as is” and “as available” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. Hijinx does not guarantee that the App will be error- free, secure, or uninterrupted.

13. Limitation of Liability

To the fullest extent permitted by law, Hijinx Media Corporation shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the App, even if we have been advised of the possibility of such damages.

14. Governing Law and Dispute Resolution

  • These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.
  • Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in California, except that either party may seek injunctive relief in a court of competent jurisdiction.

15. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms in the App or via other reasonable means. Your continued use of the App after such changes constitutes your acceptance of the revised Terms.
